Hate Crime Unreported on Hispanic Citizen... Arizona



Gary Kelley's murder trial in Phoenix, was declared a mistrialby Judge Susan Brnovich, as she ruled in  the proceeding---deliberated by an all 'White' jury. 
This Hate-Crime, has gotten very little publicity, as the wave spreads over the State. 
Kelly is known for his hate-crime against Mexican/American Juan Varela, in the aftermath of sb1070. He was charged with Murder, as he took the life of Varela, and admitted to doing so. 
He states.....
..."You f******g Mexican, go back to Mexico!...If you don't go back to Mexico, you're going to die!..."
Despite the fact that Varela was a US Citizen?
According to Kellys attorney, 
... "Kelley approached Juan Varela to talk about Arizona's new immigration law, SB 1070, and shot Varela in self-defense."..
Note; the attorney representing Kelly even stated that Kelly 'approached' Varela not the vise-versa. 
Though as the Phx Pd noted;.. Varela was--  'unarmed' -- furthermore, the Phoenix Police went on to state..
..."I observed the subject was holding what appeared to be two beer bottles in his hand. The subject had a smile on his face and put one of the bottles to his mouth and tilted the bottle up and gulped. The subject then took the other bottle and held it  over his head. Beer poured out of the bottle onto his head and he shook his head back and forth."...
If you have been keeping up with the 'Az's New Hate Blogs'.. you will have seen how the Hispanic Community has been under attack by the hate-fest that has engulfed this State..
Juan Varela and his family have become victims of it. Not only by the loss of his life, but by the injustice incurred to him by the all white jury.. 
County Attorney Jerry Cobb, has stated that they are preparing to retry the case before a new jury. A new trial date will be set next Thursday 2/17. 
Outside of only a slight acknowledgement by  ~azc~ , no mention of 'hate' was ever published.? 
This was a blog to remind those who are in disbelief that this hate is occurring here.? Part-8 will continue the series where it left off..

Hispanics -Profiled, Detained, and Civil Rights violated in City of Chandler..Arizona



Many are unaware of the 'sweeps' that occurred prior to Arpaio and his infamous Hispanic roundups? He is more commonly known  to violate Hispanic Citizen Civil Rights-in modern times (or nowadays), every time he conducts his targeting of Hispanics. The crime of being ..'guilty of being brown'... is very prevalent -as his Dept. and Posse members continue to detain US Citizens who are of Hispanic descent.
The MCSO's pending Civil Rights lawsuits continue to mount....as....Maricopa County and its taxpayers are- 'left on the hook'  for his continued -lawless and rampant disregard for Civil Rights....Though that blog subject is left for another day.
In this case; the City of Chandler decided to conduct a similar style 'sweep'. Well before the 287g authority had been considered or afforded to the Cities Law Enforcement agencies.... and.... of course well before Arpaio decided to become the media hound of modern times for the same thing. 
287g, grants authority to local Police and Sheriff's Depts., to ask an individual about their immigration status..
Chandler, in this case-- took it on its own merit in 1997 to round up all Hispanics it came across.. This was unprecedented, and no other Arizona city had attempted this previously?
What it came across was, as its findings became public -were that in many instances, Police were rounding up US Citizens, who were guilty of nothing more than ...'being brown'...? In this case they either lived in Chandler, or were shopping, conducting business, or were simply passing through the City to get to another destination? 
Remember there was no crime committed by this very large Mexican/American ethic minority,  just the fact they were Hispanic. 
What the City of Chandler came to realize in the aftermath of the roundups? Was that they knew that they committed gross negligence on their part --to have allowed and to have condoned this behavior to have occurred within City boundaries?
Subsequently, the city was sued for an estimated 35 million for violating these Hispanic Citizens Civil Rights.
The victims of the roundups, were awarded large payouts. These payouts  came courtesy of the Class Action Lawsuit brought to the city, by prominent Civil Rights Attorney Stephen Montoya, and theACLU. The tab to pay the award came courtesy of the taxpayers, and very bigoted agendas put forth by the City of Chandlers leaders, at the time.. 
This is a reminder to those who run the City now, as they have opposed this agenda/stance since their Lawsuit judgment/settlement was imposed on them. In other words, they publicly oppose any type of 'roundup' style of law enforcement -to occur within their jurisdiction. 
High price to pay, for bad decisions made previously by the City of Chandler..
It is an eniterly different story in the case of Maricopa County. Here it is still ok for this behavior to continue and cost the taxpayers... As the supporters of this bigoted agenda, are ok with wasting taxpayer dollars to continue to target Hispanic Citizens, and payout their subsequent lawsuits............... Arizona's New Hate Movement at its finest..as mentioned --it will be left for another blog..

The State Highway Patrol targets Hispanics....Arizona



It is a difficult task to see, as one may not relate to the aspects of being targeted as a minority..?
Its becomes more clouded as this behavior becomes more and more mainstream. In an ideal world there would be no anonymousity towards others who looked different, had different religious beliefs, came from a different backgound, or simply had a different view outside of what is considered the normal-mainstream.?
In this instance...
This becomes more clear and blatant as the targeting of minorities is done so without impunity...as in case of the Hispanics and Blacks in this State being targeted. Moreover,  not just by those who are simply opposed to these groups (bigots), but in this instance.., it comes from those who are -sworn to uphold and protect the law..
As was in the case of: Arnold -v- Arizona Department of Public Safety (DPS-Highway Patrol).
In this Class Action Lawsuit, the victims of the racial profiling were singled out specifically for no other reason other than -being a minority.
According to Alessadra Soler Meetz, of the ACLU, the report by the DPS's own admition stated..:
..."Searches being conducted by the majority of DPS officers continue to target minorities,  despite the fact that people of color are less likely than 'whites' to be transporting drugs, weapons or other illegal contraband..."
Furthermore, the allegations go on to state..
..."The report also shows that minorities are detained for longer periods of time after being stopped by DPS officers..." 
In the findings of the report by the DPS they mention;
..."This unequal treatment was not justified by higher contraband seizure rates from minority motorist..." 
Notice the mention of the words---not justified.
Very profound words, as the continued hate in Arizona gains its momentum.. 
This lawsuit cost taxpayers, no differently that the ones occurring now -as the Arpaio rounds ups, of Hispanics continually violates the -US Citizens of Hispanic descents civil rights. (That is another blog subject of the New Hate in Az., as his costs to the taxpayers surmount to over 40 million and in lost lawsuit payouts and judgements-and still counting)
The DPS's costs were not just for the the violation, (the citizens who they wronged) it was also for the costs of defending itself in the costly ongoing court battles. In addition to the courts subsequent findings of the DPS's violations, it also awarded the cost of attorneys fees, brought by the plaintiffs who were decriminated against is this lawsuit. One would think that this could not occur in today's time, or this was a practice of the past.? In this case it was settled in court as recently as 2008. 
The Hate, is now becoming more clear in this series, as the racial profiling aspect -has tied this subject into todays's New Hate Movement.

Racial Profiling...Arizona



Not differently than the blog that highlighted the Lowrider scene, and the fact that the Hispanic drivers then were constantly harassed and unjustly stopped for no other reason than being brown.? 
The targeting of Hispanics in Arizona, by no uncertain terms, was not limited to these nice looking rides and their very dedicated drivers. 
Most are unaware of incidents of racial profiling practices, that were generally swept under the rug by the local police departments, cities, towns and media.? 
It was and will continue to be prevalent in this State and of course others. At least until the hate stops veiwing this ethnic minority or other minorities-as second class...or.....  until laws are changed to stop this common practice from continuing. 
In the early 90's, in small town Arizona--there was one of these 'swept under' cases.
Oro Valley a small suburb of Tucson..,.sits just north of this metropolis, and is generally bypassed by those travelers who have to get to other areas North of the city..Oracle, Globe, etc.
One of the towns elected officials at the time, from Mammoth Az., Fred Sanchez, noticed his community was getting stopped more often than not, by Oro Valleys police force. He did further research, asked around and conversed with the local Copper Miners-- from the nearby town of San Manuel, and found this to be the case- similarly with them.
His investigation revealed the only common factor in these 'unjust' stops were that they were all Hispanic.  
Being on the proactive side of the elected Town Government, he made contact with then Oro Valley Magistrate Royal Bouscher. This was not a highly uncommon practice then, for to persons of political influences to air out their differences in a back door meeting. 
He went on to ask the Magistrate of OroValley, why his citizens and the miners were getting stopped for no reason other than being Hispanic, every time they went through his town.? 
One can guess as to what was exchanged between the two, as the media seemed to ignore it completely. 
It is alleged that this answer was -as speculation arose, that Bouscher needed a new building to hold his courts, and in no uncertain terms, he thought the police force saw their easy money in targeting the Hispanics who commuted through there daily. 
Granted this is only speculation, though the Hispanic community did get stopped there often enough to raise concern, and Oro Valley Magistrate did get its new building.. Furthermore, the contact was made between the two.
More commonly and well known --are the cases in which lawsuits have been introduced. In part -6 of this series, I will highlight a portion where the DPS was involved and its subsequent lawsuit.

The attack on the Chicano Movement..Arizona



The Hispanic culture runs deep in Arizona. One does not have to travel far in any direction to get a taste of the real Southwest.
I have mentioned how the 'Hate' movement in Arizona has never stopped their assault on the Hispanic population?
How I will tie the Old Hate to the recently taken over-  New Hate? Will be more clear once this series is finished. 
To get there, one has to understand the cultures and traditions of this very large ethnic minority. What are their likes and dislikes.? What music do they listen to? Clothes, foods, etc.., yes even what language this group prefers to speak while in the comforts of their own homes..?  
In this case, its more of a lifestyle, of sorts.. Yes, the southwest and Chicano culture runs along side of its very --Mexican/American ancestry.. 
This lifestyle in Arizona, came into play in the 70's and early 80's. It is known by most today, as'Lowriding'.. These are Custom Cars which are seen in Car Shows, and sometimes seen cruising the streets of Arizona, for their group functions, or to meet others and show off their rides. 
This movement of the 'Chicano' (Mexican/American) culture originated in Southern California. It was common for these Mexican/Americans to bring over the new styles and showcase their 'rides'.. in the Arizona, scene.. 
This movement was helped by fledging Chicano Movement Magazines such as Q-Vo mag, Firme mag, Teen Angel mag, and Lowrider Mag..  These magazines highlighted the best of the best- of this group. They helped in setting the trends-- that were just getting started in the Hispanic community back then.. 
In this case, they helped combat the stereotype of Hate amongst the business community and the various police agencies.
These two groups -the businesses and police classified the Chicanos and their Lowrider Movementas all 'gang' related..
This peaceful group of Hispanics who just wanted to show off their cars, had targets placed on them.  In this case, they were found guilty of having committed a crime, when the only crime was that they were in violation of; ...was- being a  Hispanic with nice car..? 
They created large Car Clubs, who were also at times, mistaken and classified as 'gangs' by the local police. Some of these early Arizona Clubs include: Destiny, Spirit, Sophisticated Few, Society, Groupe, Stylistics, Dukes, Imperials, Carnales,  and many others. 
If it weren't for these Magazines and the prominent members of the local scene, calling out the hate, this targeting of Chicanos may never have stopped...?
The first attempt at a Car Show, brought much disdain and animosity towards these Hispanics. Predominant members such as Johnny Lozoya, Sonny Madrid, Alberto Lopez, Benjamin Hernandez, and others..., stepped up and made it possible to have this Chicano Movements first ever car show. This didn't occur in Phx., (no surprise there) as the buisineses community didn't want to host a Hispanic event, and this left little choice as far as venues..?
The Native American Tribe, offered its land with open arms in '79, and Firebird Lake became the first venue in Arizona to host such an event.
Its success, was well received by the business community, and the subsequent years that followed, the 'gang' show was allowed to continue at the Az., Convention Center and Fairgrounds. 
Todays Car Clubs have seen their community  attacked again. The New Hate in Arizona, has now been felt by all the Hispanics as now this community-- according to Sen. Russell Pearce, is the new number one priority to set its sights on. The economony can wait according to him. Hispanics and all associated with this group are on the New Hate agenda. 
Which is why the Car Clubs of today generally- attend, support, and protest, along with civil rights, human rights organizations, and other the groups who are opposed to this constant and seemingly never ending hate, directed at Hispanics. 
Part-5, of this series will further highlight the bigotry and hatred directed at Hispanics in Arizona and give a more modern day prospective.

The Attack on the Barrios...Arizona



When ASU is mentioned, most think of higher education, and the advancement of students.. (With our current trends of cutting this portion of the budget by Brewer, there is an excellent argument to be made otherwise..? That subject is is left for another day.) Today you will see another side to the History of where ASU sits. 
This blog is focusing on the attacks on predominantly Hispanic neighborhoods.. If you are originally from Arizona, you are familiar with .."Campito, Hollywood/9th-st,  Duppa Villa, Hayden Park, Chula Vista, Cuatro Milpas, Green Valley and others.. 
Today's focus on two of the larger and older Barrio's --Golden Gate and La Victoria, and the attack on them.., as the 'Hate' in the past put these once very thriving communities in the cross hairs of those who saw easy targets.. 
Similarly to what occurred in San Diego, and its quest to target Hispanics. I-5 cut through the largest Hispanic neighborhood in the Southwest at the time --Logan. This occurred as the White community rezoned it from residential to industrial.. Only a concrete reminder -made into a makeshift park called affectionately as- Chicano Park, now remains.. 
Today where Golden Gate once sat? Is now the west end of the I-10 and the airport. The only remaining structure is the Church of the Sacred Heart.
Mass is still held there once a year, as its former residents attend services to keep the City of Phx from tearing it down. Phoenix saw the Hispanic community as a potential easy way of getting their much needed freeway and at the same time getting rid of the Hispanic neighborhood. Today only memories of the former residents of Golden Gate, and those who attend the Mass, remain..  
Back to ASU, many are not aware of the history where the campus sits now.? This was another predominately Hispanic neighborhood. The city of Tempe needed room for its campus expansion, and in lieu of finding another suitable location? They went after the Hispanic community.. Like San Diego, they rezoned the land and Eminent Domain took precedence. 
All the Hispanics living there were told in no uncertain terms to get out.. They reluctantly complied, and relocated to what was known as Victory Acres, or more commonly known now as La Victoria. this Barrio still remains today.

The Poisoning of Hispanics..Arizona



Some have questioned whether the Hate Trend that has engulfed this state had anymore substance in regards to the Copper Industry.?
I posted a blog in part-1 of this series that resonates with the Hispanic community from Arizona. The current 'Hate' movement will be attributed to the ongoing history of hate in this State. 
Some questioned whether or not it was only an issue from the past, or maybe could be related to only the mining communities..?
I will remind those that I have started with the hate in the Copper communities, though my argument that it is still occurring --will remind those who have had their disputes ..with the targeting of Hispanics -including and especially the Copper Communities....Will soon see the light.
In a letter to ASARCO inc., one of the largest Copper Companies in Arizona, from Senator Elliot Shapleigh (Texas State Sen) dated Jun/08.. 
It stated in great detail as it quotes..
..."We see a close similarity between those disparities in lead cleanup standards and other "standards" for Hispanics in the areas in the United States. In a 1990 investigation of an ASARCO smelter in Hayden, Arizona, William E. Craig, an ASARCO worker with the Local 866 Steelworkers Union, found that Mexican-Americans who received OSHA physicals had their results falsified to show healthier results than those actually collected..." 
This statement is further verified by Dr David K. Parkinson.. who wrote
..." predicted values in Hispanics were being reduced by 15%.." ... 
Most would believe that in modern times this could not occur on this level.? I ask you talk to the Hispanic Communities that have been under siege of the poisons from these mining companies...?
If there was doubt the the Hispanic population has had long time targets in Arizona, it can now not be disputed.
